2. Collection and storing of personal data and nature and purpose of their use

a) Visiting our website
When you visit our website www.drschenk.com, www.schenkvision.com and www.drschenkasia.com, the bowser used in your device automatically sends information to the server on which our website is located. The following information is gathered and stored temporarily until its final deletion in a so-called log file:

  • IP address of requesting device
  • Date and time of access
  • Name and URL of the requested file,
  • Website from which the access occurred (referrer URL),
  • Browser and operating system in use on your device as well as name of your access provider.

We collect these data for the following purposes:

  • Ensure unobstructed operation of the website
  • Ensure convenient use of our website

The legal foundation for this collection of data is Article 6, Section 1, Sentence 1, lit. (f) GDPR.

 

b) Using our contact form and the Virtual Booth Experience
You can contact us by using a contact form provided on our website. This requires you to enter your given name and family name, company name and a valid e-mail address so we know by whom the inquiry was sent and respond to it. You have the option of entering additional information. Data processing for the purpose of contacting us is done according to Article 6, Section 1, Sentence 1, lit. (a) GDPR with your voluntarily provided consent. The personal data collected in connection with using our contact form are deleted automatically after your inquiry has been processed.

 

c) Use of our Inspection Academy
We offer our customers the ability to train employees within our virtual Inspection Academy. This requires you to enter your given name and family name, company name and a valid e-mail address so we know who wishes to log in to our Inspection Academy. Data processing for the purpose of using the Inspection Academy is done according to Article 6, Section 1, Sentence 1, lit. (a) GDPR with your voluntarily provided consent. The personal data collected in connection with using the Dr. Schenk Inspection Academy are automatically deleted after 5 years.

 

3. Transfer of data
We do not transmit your personal data to third parties except for the purposes listed. We only transmit your personal data to third parties if and when:

  • You have given your explicit consent according to Article 6, Section 1, Sentence 1, lit (a) GDPR
  • Transmitting is necessary in order to enforce, exercise or defend legal claims according to Article 6, Section 1, Sentence 1, lit (f) GDPR and there is no reason to suspect that you have an overriding interest to retain your data
  • There is a legal obligation to transmit the data according to Article 6, Section 1, Sentence 1, lit (c) GDPR, and
  • This is permitted by law and according to Article 6, Section 1, Sentence 1, lit. (b) GDPR is necessary to manage contracts with you.

 

4. Cookies and Social Media Plugins

We use only technically necessary COOKIES on our website to enable login within protected areas of the site. We do not use any social media plugins (e.g. Facebook, Twitter, and Instagram).

 

5. Online Applications

You can apply to for a job at Dr. Schenk online. The online application tool enables you to transfer your personal data to us. These data and all provided documents are treated confidentially in accordance with applicable data protection regulations.

You can enter data regarding your person and your contact information. Some entries are required for submitting the application. These include, for example, your surname, given name and e-mail address. These data are marked as required fields.

In addition, you can voluntarily submit further information such as curriculum vitae, certificates/references, and more.

Your data are processed primarily by our personnel department and the functional manager, the latter being in charge of filling the position and can be made available to other departments if necessary. The confidentiality of your data is maintained throughout owing to the processes we have established.

The processing of your data serves the main purpose of entering into a contract of employment. The primary legal foundation for this collection of data is Article 88, Section 1, DSGVO and article 26, section 1 of the German Data Protection Act (BDSG).

Deletion of Applicant Data

In the event that an applicant was not selected, their data will be stored for 6 months and then deleted.

 

6. Your rights as data subject
According to the GDPR you have the following rights:

  • Right of confirmation and access regarding your personal data which is being processed by us according to Article 15 GDPR. In particular you can obtain information regarding the purposes of processing; the categories of personal data concerned; the categories of recipients concerned to whom the personal data have been or will be disclosed; the envisaged period for which the personal data will be stored; rectification or erasure of personal data or restriction of processing from us or to object to such processing; right to lodge a complaint with a supervisory authority, and where the personal data are not collected from the data subject any available information as to their source; the existence of automated decision-making, including profiling and significance and the envisaged consequences of such processing
  • Right of rectification without undue delay according to Article 16 GDPR regarding inaccurate or incomplete personal data
  • Right to erasure (”right to be forgotten“) according to Article 17 GDPR, unless processing is necessary to ensure freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for establishment, exercise or defense of legal claims;
  • Right to restriction of processing according to Article 18 GDPR, if you contest the accuracy of the data, the processing is unlawful and you oppose erasure of the data and we no longer need the data but you require them for the establishment, exercise or defense of legal claims or you have objected to processing pursuant to Article 21, Section 1 GDPR pending verification whether our legitimate grounds override yours;
  • Right to data portability according to Article 20 GDPR regarding your data with which you have provided us in a structured, commonly used and machine-readable format and transmit those data to another controller as far as this is technically feasible;
  • Right to withdraw consent according to Article 7 Section 3 GDPR; you can withdraw your previously given consent at any time; as a consequence we shall from then onward not be permitted to process your data any further;
  • Right to lodge a complaint with a supervisory authority according to Article 77 GDPR; you can generally contact a supervisory authority of your habitual residence, place of work or our company headquarters.

Inasmuch as your personal data is processed with legitimate interest according to Article 6, Sentence 1, lit (f) GDPR you have the right to object to the processing of this data according to Article 21 GDPR, based on grounds relating to your particular situation or insofar as the objection is lodged against direct marketing. 8. Data security
During a visit to our website we use the commonly applied SSL procedure (Secure Socket Layer) in connection with the highest encryption supported by your browser. Typically this is a 256 bit encryption. Should your browser not support 256 bit encryption we will use 128 bit v3 technology instead.
